These Terms and Conditions (hereinafter, the «Terms») govern access to and use of the NOMAD website and the associated informational services provided by PT. NOMAD DEVELOPMENT GROUP (hereinafter, «NOMAD»). Accessing the website implies full and unreserved acceptance of these Terms, together with the Legal Notice, the Privacy Policy and the Cookie Policy.

1. Purpose

NOMAD makes available to users an informational website regarding its hybrid hospitality and real estate model in Lombok (Indonesia), its projects, events and opportunities for travellers and investors. Through the website it is possible to:

  • Consult information about projects and events.
  • Request dossiers and detailed information.
  • Subscribe to informational communications.
  • Start conversations through messaging channels such as WhatsApp.

2. Non-binding nature of the information

All information published on the website is purely informational in nature. It does not constitute a binding offer of investment, contract, financial recommendation or professional advice. Figures relating to profitability, occupancy, deadlines or timelines are indicative and subject to change.

Any potential contractual relationship (booking, investment, accommodation, sale and purchase or service of any nature) shall be governed by the specific documentation signed with NOMAD and, where applicable, with the special purpose vehicle companies of each project.

3. User status

Use of the website confers the status of user. The user declares that they are of legal age and have sufficient legal capacity to accept these Terms. The user undertakes to:

  • Make diligent, lawful and good-faith use of the website.
  • Not use the website to carry out activities contrary to the law, morality or public order.
  • Not introduce, store or disseminate viruses, malicious software or any element that may damage the systems of NOMAD or third parties.
  • Not use the site to send unsolicited communications or to impersonate third parties.

4. Intellectual and industrial property

All website content is owned by NOMAD or its licensors. Access to the site does not imply any licence or assignment of rights over it. 9. Modification of the Terms

NOMAD may modify these Terms at any time, publishing the updated version on this same website. The date of the last update appears in the header of the document. Continued use of the website following the publication of the changes shall be deemed acceptance of the new Terms.

10. Partial invalidity

If any of the clauses of these Terms is declared null, illegal or unenforceable by a competent authority, that clause shall be deemed not to be included, without this affecting the validity of the remaining clauses.

11. Applicable law and jurisdiction

These Terms are governed by the laws of the Republic of Indonesia, without prejudice to the mandatory consumer protection rules applicable in the user's country of residence.

For the resolution of any dispute, the parties submit to the courts of the Owner's domicile, unless the mandatory regulations determine a different jurisdiction. Consumer users residing in the European Union are hereby informed of the existence of the European online dispute resolution platform, available at https://ec.europa.eu/consumers/odr.
